1 Geltungsbereich
1.1 Diese besonderen Nutzungsbedingungen der Schwarz Campus Service GmbH & Co. KG für die Nutzung der CampusCard durch Gäste („Besondere Nutzungsbedingungen für Gäste“) gelten zwischen der Schwarz Campus Service GmbH & Co. KG, Stiftsbergstr. 1, 74172 Neckarsulm, („SCS“) sowie autorisierten Gästen des Bildungscampus Heilbronn („Gast“ im Sinne der Ziffer 1.4 und/oder „Nutzer“), welche die CampusCard, also eine Identifikationskarte mit erweitertem Funktionsumfang („CampusCard“), auf dem Bildungscampus Heilbronn sowie in allen in der Verwaltung der SCS stehenden Gebäuden (zusammen „Nutzungsgebiet“) nutzen.
1.2 Diese Besonderen Nutzungsbedingungen für Gäste ergänzen die Allgemeinen Nutzungsbedingungen der Schwarz Campus Service GmbH & Co. KG für die Nutzung der CampusCard („Nutzungsbedingungen“), die dem Vertrag mit dem Nutzer zugrunde liegen und regeln besondere Rechte und Pflichten der Parteien bezüglich der Ausgabe an und die Nutzung der CampusCard durch Gäste sowie die Anwendbarkeit einzelner Bestimmungen der Nutzungsbedingungen.
1.3 Im Falle von Abweichungen zwischen den Nutzungsbedingungen und diesen Besonderen Nutzungsbedingungen für Gäste, gehen diese Besonderen Nutzungsbedingungen für Gäste vor.
1.4 SCS stellt die Nutzung der CampusCard sowohl Kurzzeit-Gästen, die sich einmalig im Nutzungsgebiet aufhalten („Kurzzeit-Gast“), als auch Langzeit-Gästen, die sich regelmäßig im Nutzungsgebiet befinden („Langzeit-Gast“, gemeinsam mit dem Kurzzeit-Gast „Gast“), zur Verfügung.
2 Abweichende Bestimmungen
2.1 Folgende Bestimmungen der Nutzungsbedingungen finden auf die Ausgabe an und die Nutzung der CampusCard durch Kurzzeit-Gäste keine oder nur im angegebenen Umfang Anwendung:
a) Ziffer 2 (Ausgabe der CampusCard und Registrierung) – Die Ausgabe der Campus-Card an Kurzzeit-Gäste erfolgt ausschließlich über die sich im Nutzungsgebiet befindlichen Aufwerter. Eine Registrierung ist für Kurzzeit-Gäste nicht erforderlich. Für Kurzzeit-Gäste werden keine Stammdaten zur Verfügung gestellt. Ein Erhalt der CampusCard ist ohne vorherige Registrierung mittels der sich im Nutzungsgebiet befindlichen Aufwerter möglich. Für den Vertragsschluss gilt abweichend die nachstehende Ziffer 3.1.
b) Ziffer 3.6 (Pflege der Daten im Nutzerkonto) – Der Kurzzeit-Gast hat keinen Zugriff auf ein Nutzerkonto, so dass die Verpflichtung zur Aktualisierung von Daten entfällt.
c) Ziffer 5.1.5 (Aufwertung) – Eine Aufwertung der CampusCard ist für Kurzzeit-Gäste ausschließlich an den sich im Nutzungsgebieten befindlichen Aufwertern möglich.
d) Ziffer 5.1.8 (Zahlungsbeleg) – Kurzzeit-Gäste erhalten einen Rechnungsbeleg ausschließlich bei der in Anspruch genommenen Akzeptanzstelle.
e) Ziffer 5.1.10 (Verlust der CampusCard) – Bei Verlust der CampusCard erfolgt keine Aufwertung einer neu ausgegebenen CampusCard.
f) Ziffer 5.2 (Nutzungsberechtigungen für Parkflächen) – Kurzzeit-Gäste erhalten keine Nutzungsberechtigungen für Parkflächen.
g) Ziffer 6 (Zutrittsberechtigungen) – Kurzzeit-Gästen werden keine Zutrittsberechtigungen eingeräumt.
h) Ziffer 8 (Deaktivierung der CampusCard) – Die an einen Kurzzeit-Gast ausgegebene Campus-Card wird nicht automatisch deaktiviert. Der Kurzzeit-Gast hat jedoch die Möglichkeit, die Campus-Card jederzeit mittels eines sich im Nutzungsgebiet Aufwerters zurückzugeben und eine Auszahlung des sich auf der Campus-Card befindlichen Restguthabens zu veranlassen.
i) Ziffer 9 (Ersatz der CampusCard) – Bei Verlust, Diebstahl oder sonstigem Abhandenkommen der CampusCard oder bei einem technischen Defekt der CampusCard, kann sich der Kurzzeit-Gast eine neue CampusCard an einem im Nutzungsgebiet befindlichen Aufwerter ausgeben lassen.
j) Ziffer 11.1 und 11.2 (Laufzeit und Kündigung); hier gilt abweichend die nachstehende Ziffer 4.
2.2 Folgende Bestimmungen der Nutzungsbedingungen finden auf die Ausgabe an und die Nutzung der CampusCard durch Langzeit-Gäste keine oder nur im angegebenen Umfang Anwendung:
a) Ziffer 2 (Ausgabe der CampusCard und Registrierung) – Die Ausgabe der Campus-Card an Langzeit-Gäste erfolgt ausschließlich über den Empfang des Bildungscampus oder über die zuständigen Einrichtungen mittels eines entsprechenden Ausgabeformulars. Für Langzeit-Gäste werden keine Stammdaten zur Verfügung gestellt. Eine Registrierung im Sinne der Ziffer 2 der Nutzungsbedingungen ist für Langzeit-Gäste nicht erforderlich. Für den Vertragsschluss gilt abweichend die nachstehende Ziffer 3.2.
b) Ziffer 3.6 (Pflege der Daten im Nutzerkonto) – Der Langzeit-Gast hat keinen Zugriff auf ein Nutzerkonto, so dass die Verpflichtung zur Aktualisierung von Daten entfällt.

e) Ziffer 5.2 (Nutzungsberechtigungen für Parkflächen) – Langzeit-Gäste erhalten nur eingeschränkte Nutzungsberechtigungen für Parkflächen.
f) Ziffer 6 (Zutrittsberechtigungen) – Langzeit-Gästen werden nur eingeschränkte Zutrittsberechtigungen eingeräumt.
g) Ziffer 8 (Deaktivierung der CampusCard) – Die an einen Langzeit-Gast ausgegebene Campus-Card wird nach Ablauf der bei Vertragsschluss mitgeteilten Gültigkeitsdauer automatisch deaktiviert. Der Langzeit-Gast hat auch die Möglichkeit, die Campus-Card jederzeit mittels eines sich im Nutzungsgebiet befindlichen Aufwerters eine Auszahlung des sich auf der Campus-Card befindlichen Restguthabens zu veranlassen und die CampusCard bei der Ausgabestelle zurückzugeben.
h) Ziffer 11.1 und 11.2 (Laufzeit und Kündigung); hier gilt abweichend die nachstehende Ziffer 4
3 Vertragsschluss; Registrierung und Nutzerkonto
3.1 Für Kurzzeit-Gäste ist ein Erhalt der CampusCard und der entsprechende Vertragsschluss zur Nutzung der CampusCard ohne vorherige Registrierung mittels der sich im Nutzungsgebiet befindlichen Aufwerter gegen einen Pfandbetrag möglich. Der Vertragsschluss erfolgt für Kurzzeit-Gäste bei der Ausgabe der CampusCard durch den Aufwerter. Die Erstattung des Pfandbetrags erfolgt bei der Rückgabe der CampusCard.
3.2 Die Nutzung der CampusCard durch Langzeit-Gäste setzt eine Registrierung des Langzeit-Gastes beim Empfang des Bildungscampus oder bei der für ihn zuständigen Einrichtung mittels eines entsprechenden Antragsformulars voraus. Der Vertragsschluss erfolgt für Langzeit-Gäste bei der Ausgabe der CampusCard durch das Personal des Empfangs des Bildungscampus oder durch die für ihn zuständige Einrichtung.
3.3 Weitere Informationen zum Erhalt der CampusCard durch den Gast sind auf der Webseite unter www.bildungscampus.hn einsehbar.
4 Vertragslaufzeit
4.1 Der Vertrag zwischen SCS und dem Kurzzeit-Gast wird auf unbestimmte Zeit geschlossen. Er endet mit Rückgabe der CampusCard durch den Kurzzeit-Gast.
4.2 Der Vertrag zwischen SCS und dem Langzeit-Gast wird auf die beim Vertragsschluss angegebene Gültigkeitsdauer geschlossen. Er endet spätestens mit Ablauf dieses Zeitraums automatisch.
4.3 Der Gast kann diesen Vertrag jederzeit ohne Einhaltung einer Kündigungsfrist durch Rückgabe der CampusCard kündigen.
4.4 Im Falle einer Kündigung oder Beendigung dieses Vertrags gleich aus welchem Grund, ist eine Nutzung der CampusCard durch den Gast nicht mehr möglich.

1. Scope of Application
1.1 These Special Terms and Conditions of Use of Schwarz Campus Service GmbH & Co. KG for the Use of the CampusCard by Guests ("Special Terms and Conditions of Use for Guests") apply to the relationship between Schwarz Campus Service GmbH & Co. KG, Stiftsbergstr. 1, 74172 Neckarsulm, Germany ("SCS") and authorized guests at the Heilbronn Bildungscampus ("Guests" as defined in clause 1.4 and/or "Users") who use the CampusCard, an ID card featuring extended functions ("CampusCard") at the Heilbronn Bildungscampus and all facilities that are managed by the SCS (collectively the "Area of Use").
1.2 These Special Terms and Conditions of Use for Guests supplement the Standard Terms and Conditions of Use of Schwarz Campus Service GmbH & Co. KG for the Use of the CampusCard ("Terms and Conditions of Use"), which form the basis of the contract with the User and govern special rights and obligations of the parties with regard to the issue of the CampusCard to and use of the CampusCard by Guests, as well as the application of certain provisions of the Terms and Conditions of Use.
1.3 These Special Terms and Conditions of Use for Guests shall take precedence in the event that they diverge from the Terms and Conditions of Use.
1.4 SCS provides the CampusCard for use by both short-term guests who visit the Area of Use once ("Short-term Guests") and long-term guests who regularly visit the Area of Use ("Long-term Guests", referred to collectively with Short-term Guests as "Guests").
2. Divergent Provisions
2.1 The following provisions of the Terms and Conditions of Use do not apply or apply only to the specified extent to the issue of the CampusCard to and use of the CampusCard by Short-term Guests:
a) Clause 2 (Issue of CampusCard and Registration) – CampusCards are issued to Short-term Guests only at the terminals located in the Area of Use. Short-term Guests are not required to register. No master data is provided for Short-term Guests. CampusCards may be obtained from the terminals located in the Area of Use without prior registration. By way of derogation, clause 3.1 below applies to conclusion of the contract.
b) Clause 3.6 (Updating User Account Data) – Short-term Guests have no access to a user account, so therefore have no obligation to update their data.
c) Clause 5.1.5 (Top-up) – Short-term Guests can only top up their CampusCard at the terminals located in the Area of Use.
d) Clause 5.1.8 (Payment Receipt) – Short-term Guests can only receive a payment receipt at the point of acceptance used.
e) Clause 5.1.10 (Loss of CampusCard) – In the event of loss of the CampusCard, no credit will be applied to any replacement card.
f) Clause 5.2 (Authorizations to Use Parking Areas) – Short-term Guests are not able to obtain authorization to use parking areas.
g) Clause 6 (Access Authorizations) – Short-term Guests are not granted any access authorizations.
h) Clause 8 (Deactivation of CampusCard) – CampusCards issued to Short-term Guests are not automatically deactivated. However, Short-term Guests have the option of returning the CampusCard at any time at a terminal located in the Area of Use and obtaining a refund of the remaining balance on the CampusCard.
i) Clause 9 (Replacement of CampusCard) – In the event of loss, theft or other misplacement of the CampusCard or a technical defect of the CampusCard, Short-term Guests may arrange for a new CampusCard to be issued at a terminal located in the Area of Use.
j) Clause 11.1 and 11.2 (Term and Termination) – by way of derogation, clause 4 below shall apply.
2.2 The following provisions of the Terms and Conditions of Use do not apply or apply only to the specified extent to the issue of the CampusCard to and use of the CampusCard by Long-term Guests:
a) Clause 2 (Issue of CampusCard and Registration) – CampusCards are issued to Long-term Guests only at the reception desk of the Bildungscampus or by their responsible institution following submission of the relevant application form. No master data is provided for Long-term Guests. Long-term Guests are not required to register in accordance with clause 2 of the Terms and Conditions of Use. By way of derogation, clause 3.2 below applies to conclusion of the contract.
b) Clause 3.6 (Updating User Account Data) – Long-term Guests have no access to a user account, so therefore have no obligation to update their data.
c) Clause 5.1.5 (Top-up) – Long-term Guests can only top up their CampusCard at the terminals located in the Area of Use.
d) Clause 5.1.8 (Payment Receipt) – Long-term Guests can only receive a payment receipt at the point of acceptance used.
e) Clause 5.2 (Authorizations to Use Parking Areas) – Long-term Guests may obtain only limited authorization to use parking areas.
f) Clause 6 (Access Authorizations) – Long-term Guests are granted only limited access authorizations.
g) Clause 8 (Deactivation of CampusCard) – CampusCards issued to Long-term Guests are automatically deactivated following expiry of the validity period notified upon conclusion of the contract. Long-term Guests also have the option of obtaining a refund of the remaining balance on the CampusCard at any time at a terminal located in the Area of Use and returning the CampusCard to the issuing office.
h) Clause 11.1 and 11.2 (Term and Termination) – by way of derogation, clause 4 below shall apply
3 Conclusion of Contract; Registration and User Account
3.1 Short-term Guests may obtain a CampusCard and conclude a contract to use the CampusCard without prior registration at the terminals located in the Area of Use in return for the payment of a deposit. A contract is concluded with Short-term Guests when the terminal issues the CampusCard. The deposit is refunded upon return of the CampusCard.
3.2 Use of the CampusCard by Long-term Guests is contingent upon the Long-term Guest registering with the reception desk of the Bildungscampus or with their responsible institution by submitting the relevant application form. A contract is concluded with Long-term Guests when the CampusCard is issued by the staff at the reception desk of the Bildungscampus or by their responsible institution.
3.3 Guests will find further information about obtaining a CampusCard on the website at www.bildungscampus.hn.
4 Term
4.1 The contract between SCS and the Short-term Guest is concluded for an indefinite period. It ends when the Short-term Guest returns the CampusCard.
4.2 The contract between SCS and the Long-term Guest is concluded for the period of validity stated at the time of concluding the contract. It automatically ends upon the expiry of this period at the latest.
4.3 Guests may terminate this contract at any time without notice by returning the CampusCard.
4.4 In the event that this contract is terminated or ends, regardless of the reason, Guests may no longer use the CampusCard.
