By using the shuttle, the passenger enters into a contract of carriage with Schwarz Mobility Solutions GmbH (Stiftsbergstraße 1, 74172 Neckarsulm, Germany; "SMS") on the terms and conditions set out herein:
1.1 Primary contractual purpose of shuttle service in a research environment
The primary contractual purpose (material contractual obligation) is the provision of shuttle service in a research environment. The shuttle is part of a research project and has a road traffic permit. During service in a research environment, temporary stoppages in service overall may occur or individual runs may be canceled or interrupted. There is no shuttle service during inclement weather (e.g., snow, ice). Otherwise, shuttle service can only be guaranteed up to 50%.
1.2 Authorized use
Passengers who have reached the age of majority are authorized to use the shuttle. Minors aged 7 and older are authorized to use the shuttle with the consent of their legal guardian. Minors under the age of 7 are only authorized to use the shuttle if accompanied by their legal guardian.
1.3 Number of passengers
The shuttle accommodates a maximum of five passengers in addition to the safety steward.
The shuttle is free of charge.
2. Rules of conduct for passengers
Passengers must conduct themselves in an orderly fashion so as not to disturb or inconvenience fellow passengers. The safety steward's instructions must be followed. Passengers who disregard the above rules, the safety steward's instructions or otherwise pose a threat to public safety and general order may be prohibited from using the shuttle.
2.2 Seat belts
Seat belts are available and should be fastened during transport. Toddlers and babies may sit on the passenger's lap.
2.4 Wheelchairs and strollers
The shuttle interior is equipped with anchor points on the floor between the two seat benches for securing wheelchairs or strollers in the middle of the shuttle. These may only be secured by the safety steward. Wheelchairs and strollers may not be transported unless they are appropriately secured. If a wheelchair or stroller is transported, fewer passengers may be accommodated due to space constraints.
In any case, the shuttle accommodates no more than five passengers.
Toddlers and babies may not sit in strollers during transport.
2.5 Abuse of emergency exits and equipment
Passengers may not engage the emergency exit, emergency escape hammer or the emergency door release unless there is a risk to their safety or that of other passengers or persons. Any abuse of emergency exists or equipment will be prosecuted.
2.6 No alcohol
No alcohol is permitted in the shuttle whatsoever, i.e., passengers are prohibited from consuming alcoholic beverages in the shuttle or carrying them in open containers.
2.7 No smoking
There is no smoking in the shuttle; this includes e-cigarettes.
3.1 Carry-on items
Passengers may carry light portable items (carry-on items), which can be stowed on the lap without disturbing other passengers.
3.2 Other luggage
Passengers may not bring any luggage (e.g., large suitcases) other than carry-on items.
Small domestic pets (not larger than a domestic cat) which are not dangerous and are kept in closed containers (e.g., pet carriers) like carry-on items are permitted. The carriers must be designed in such a way as to exclude any risk to persons and property and to comply with the rules for carry-on items under clause 3. Dogs (not larger than a domestic cat) that can sit on their owner's lap, are leashed and suitably muzzled are permitted. Larger dogs are excluded from carriage.
5. No carriage
Items and substances that are likely to disturb or injure other passengers or damage the shuttle are not permitted. Specifically excluded from carriage are hazardous substances and items, firearms, explosive and flammable substances and items, oxidizing, toxic, radioactive, corrosive and infectious substances as well as other dangerous goods under the German Act on the Carriage of Dangerous Goods (Gesetz über die Beförderung gefährlicher Güter – GGBefG) and the German Regulation on the Carriage of Dangerous Goods by Road, Rail and Water (Verordnung über die innerstaatliche und grenzüberschreitende Beförderung gefährlicher Güter auf der Straße, mit Eisenbahnen und auf Binnengewässern – GGVSEB) enacted thereunder, mopeds or scooters and items and substances the carriage of which is prohibited under other laws and regulations. However, personal use items such as matches, lighters, aerosol cans with non-hazardous contents, and electronic recording and playback devices, cell phones, portable computers, and drones, including those with integrated lithium batteries with an energy rating of more than 100 Wh, are permitted. External batteries for a related device are only permitted if their energy rating does not exceed 100 Wh.
6. Bicycles and pedelecs
Bicycles and pedelecs are not permitted.
7. Electric micromobility vehicles
Passengers may carry an electric micromobility vehicle approved under the German Electric Micromobility Vehicle Regulation (Elektrokleinstfahrzeuge-Verordnung – eKFV) provided that it is folded and does not inconvenience fellow passengers. The integrated batteries may not be removed, charged or otherwise used (e.g., battery chargers) during transport. Any baggage fastened to the electric micromobility vehicle must be detached and transported in accordance with the rules for carry-on items.
8. Interruption of service
If service on a given shuttle run is interrupted, passengers will be notified by the safety steward and must disembark the shuttle without undue delay upon request.
SMS shall generally be liable to passengers solely for willful or grossly negligent conduct; it shall be liable for ordinary negligence in cases involving breaches of material contractual obligations (cardinal obligations) and injury to life, limb or health. However, in the event of a breach of material contractual obligations, liability to pay compensation shall be limited to contractually-anticipated, foreseeable loss or damage.

12.2 Dispute resolution
SMS is not prepared to participate in any dispute resolution proceedings before a consumer arbitration board pursuant to the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz – VSBG) nor is it obligated to participate in any such proceedings.
